Terms of Service
The rules covering this website and the client portal, and how they sit alongside the proposal you signed for the work itself.
01Agreement to these terms
These terms govern your use of the Orbit Sites website at orbitsites.store, the project intake form, and the client portal. By using any of them you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
If you do not agree, the remedy is simple: do not use the site. Nothing here obliges you to keep an account.
02These terms are not your project contract
Design and development work is governed by a separate written proposal — scope, deliverables, milestones, fixed price, and timeline — signed before work starts. That document controls the work itself.
Where these terms and a signed proposal disagree about anything to do with the engagement, the proposal wins. These terms cover the software you are looking at: the site, the portal, and your account.
03Accounts
- Accuracy — Give us a real name and an email address you control. Account notifications, invoices, and password resets all go to that address.
- Security — You are responsible for what happens under your account. Choose a password you do not use elsewhere, and tell us promptly if you think it has been compromised — changing your password signs out every other session immediately.
- One person per account — Accounts are individual. Do not share credentials. If more people at your company need access, ask us and we will create accounts for them.
- Suspension — We may suspend an account that is being used to attack the service, to abuse other users, or in breach of these terms. Suspension is reversible and we will tell you why.
04Acceptable use
Use the site for its purpose: enquiring about work, and managing an engagement with us. The following are not acceptable, and this list is illustrative rather than exhaustive.
- Probing, scanning, or testing the security of the service without our prior written permission.
- Attempting to access records belonging to another client, or any staff-only area.
- Uploading malware, or files whose purpose is to exploit a recipient rather than to inform them.
- Sending unlawful, harassing, or deliberately misleading content through the messaging system.
- Automated scraping, or load that degrades the service for others. The intake form and messaging are rate-limited; working around those limits is a breach.
- Reselling or sublicensing access to the portal.
05Content you send us
You keep ownership of everything you upload or send — briefs, brand assets, copy, files. You grant us a licence to store, process, and display it strictly for the purpose of delivering the service and the work you have engaged us for. That licence ends when the content is deleted.
You confirm you have the right to send us what you send. If you upload material belonging to somebody else, that is your responsibility, not ours.
We may remove content that breaches these terms, and we may lock a conversation that has become abusive. Where we do, the account holder is told what happened and why.
06Our content
The site design, code, copy, and brand marks are ours and are protected by copyright and trade mark law. Nothing here transfers them to you. Ownership of work product built for you under a signed proposal is governed by that proposal — typically it transfers on final payment.
07Invoices and payment
Invoices shown in the portal reflect milestones defined in your signed proposal. Payment terms, amounts, and due dates are those stated on the invoice and in that proposal.
The portal is a record of billing, not a payment processor. Where a payment method is offered, the terms of the payment provider apply to the transaction in addition to these terms. Overdue invoices may pause active work; where they do, we tell you before it happens.
08Availability
We aim to keep the portal available continuously, and we will schedule disruptive maintenance outside business hours where we can. But the portal is provided as-is: we do not promise uninterrupted availability, and no uptime figure quoted on the marketing site is a contractual commitment for the portal itself.
Service-level commitments for a site we host or maintain for you, if any, are the ones written into your retainer agreement.
09Disclaimers and liability
To the fullest extent the law allows, the site and portal are provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from your use of the site or portal. Our total liability for any claim relating to the site or portal is limited to the amount you paid us in the twelve months before the claim arose.
Nothing in these terms excludes liability that cannot lawfully be excluded — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
10Ending your access
You can ask us to close your account at any time by emailing hello@orbitsites.store. We will close it and delete your data on the schedule set out in the Privacy Policy, keeping only what tax and accounting law requires.
We may end access if you materially breach these terms and do not fix it within a reasonable period after we tell you. Ending portal access does not, by itself, terminate a signed project agreement — termination of that is governed by the agreement.
11Changes
We may update these terms. The effective date at the top changes when we do, and we will email account holders before a material change takes effect. Continuing to use the service after that date means you accept the revised terms.
12Governing law and contact
These terms are governed by the laws of the jurisdiction in which Orbit Sites is established, and the courts of that jurisdiction have exclusive jurisdiction over any dispute — without affecting any right you have as a consumer to bring proceedings where you live.
Questions about these terms go to hello@orbitsites.store.
Questions about this document, or a request about your data, go to hello@orbitsites.store. Clients with a portal account can also open a thread from the portal, which reaches the same people.
